Terms of Service

Please read these Terms carefully before using the DinePocket platform. By accessing or using our Service, you agree to be bound by these Terms.

These Terms of Service ("Terms") govern your use of the DinePocket platform ("Service") operated by DinePocket ("we", "us", "our"). By registering or using the Service, you ("Restaurant Owner", "Subscriber", "User") unconditionally accept these Terms.

1Acceptance of terms

By registering an account, making a payment, or using any feature of DinePocket, you unconditionally accept these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and DinePocket. If you do not agree, you must discontinue use immediately.

2Description of service

DinePocket provides a cloud-based QR code restaurant menu and ordering management platform on a subscription basis. The Service includes digital menu creation, table QR code generation, customer ordering interface, order management dashboard, payment notification tools, and related features as available at the time of use.

We reserve the right to add, modify, suspend, or remove any feature of the Service at any time without prior notice.

3Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use this Service. By using DinePocket, you represent that all information you provide is accurate and that you have the authority to bind any business entity on whose behalf you use the Service.

4Subscription and billing

DinePocket operates on a prepaid subscription model. Subscription fees are charged in advance for the selected billing period. All fees are non-negotiable and subject to change with reasonable notice.

  • Payments are processed through our payment gateway partner (Razorpay or as applicable).
  • Subscription begins on the date of successful payment.
  • Failure to pay on time may result in immediate suspension of your account without notice.
  • We are not responsible for any payment failures caused by your bank, card issuer, or payment gateway.
  • Taxes (GST or applicable) are charged additionally as per government regulations and are non-refundable.

5Refund policyImportant

We offer a pro-rata refund for unused days only. Refunds are processed within 7 working days of a verified cancellation request. No refund is issued for days already consumed.

  • Example: If you purchase a 30-day plan and cancel after 15 days, you will receive a refund for the remaining 15 days only.
  • Refund amount = (Total paid ÷ Total days in plan) × Remaining unused days.
  • Refunds will be issued to the original payment method only.
  • Processing fees, transaction charges, and taxes already paid are non-refundable under any circumstance.
  • No refund will be issued if your account has violated these Terms or been suspended due to misuse.
  • No refund will be issued if the cancellation request is made after the subscription has already expired.
  • No refund will be issued for downtime, maintenance periods, feature removal, or any service changes.
  • Refund requests must be submitted via email to support@dinepocket.com with your registered email and payment ID.
  • We reserve the right to deny any refund request that does not meet the above criteria.

6Service availability and maintenanceImportant

DinePocket does not guarantee uninterrupted, error-free, or continuous availability of the Service. The Platform may be taken offline for maintenance, updates, security patches, infrastructure upgrades, or any other operational reason at any time, with or without prior notice, for any duration.

The Platform may enter maintenance mode at any time, for any duration — including but not limited to a few hours, multiple days, or extended periods — without any obligation to notify users in advance or provide compensation, credit, or refund for such downtime.

  • Scheduled or unscheduled maintenance periods do not entitle you to any refund, credit, or compensation of any kind.
  • We shall not be liable for any loss of business, revenue, orders, or data resulting from Platform downtime.
  • We may temporarily restrict access to certain features or the entire Platform for security or compliance reasons.
  • Third-party service outages (hosting, cloud providers, payment gateways, SMS/email providers) are outside our control and do not entitle users to any compensation.

7Your responsibilities

As a subscriber, you are solely responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Ensuring your menu content complies with local laws, food regulations, and licensing requirements.
  • Maintaining your own internet connectivity to access the Service.
  • Informing your customers about your own return, refund, and food quality policies — DinePocket is not responsible for any dispute between you and your customers.
  • Any pricing, GST/tax figures, or order information you configure on the Platform.

8Prohibited use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Attempt to reverse-engineer, copy, resell, or redistribute any part of the Service.
  • Upload content that is defamatory, obscene, or infringes third-party intellectual property.
  • Use automated bots or scripts to access the Platform.
  • Interfere with the security or integrity of the Platform or its infrastructure.

We reserve the right to suspend or permanently terminate your account without notice or refund if any prohibited use is detected.

9Data and privacy

By using DinePocket, you grant us permission to store, process, and use the data you provide (restaurant details, menu items, order data) for the purpose of operating and improving the Service. We do not sell your data to third parties.

You are responsible for obtaining any necessary consent from your customers for data collected via your menu page. DinePocket is not a data controller for your customer data — you are.

Upon account termination, we may delete your data from our servers within 30 days. We recommend exporting any data you wish to retain before cancelling your account.

10Intellectual property

All content, design, code, branding, and technology of the DinePocket Platform is the exclusive intellectual property of DinePocket and its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your active subscription period only.

You retain ownership of the menu content and data you upload. By uploading content, you grant DinePocket a license to display and process it for the purpose of operating the Service.

11Limitation of liabilityImportant

To the maximum extent permitted by applicable law:

  • DinePocket shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, profits, data, or business opportunities.
  • Our total cumulative liability to you for any claim shall not exceed the amount you paid to us in the 30 days immediately preceding the event giving rise to the claim.
  • We are not liable for actions or inactions of third-party services including payment gateways, hosting providers, or email/SMS providers.
  • We are not liable for any loss caused by your failure to maintain accurate menu, pricing, or tax information on the Platform.

12Indemnification

You agree to indemnify, defend, and hold harmless DinePocket and its founders, employees, partners, and service providers from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any dispute between you and your customers.

13Modifications to terms

We reserve the right to update or modify these Terms at any time. We will notify registered users of material changes via email or a notice on the Platform. Your continued use of the Service after such notification constitutes your acceptance of the revised Terms.

14Account termination

Either party may terminate the subscription at any time. We reserve the right to suspend or terminate your account immediately, without notice and without refund, if you breach these Terms, engage in fraudulent activity, or if we decide to discontinue the Service.

In the event we decide to permanently shut down the DinePocket Platform, we will make reasonable efforts to provide at least 7 days notice and offer pro-rata refunds for the remaining paid period, at our sole discretion.

15Governing law and disputes

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Ludhiana, Punjab, India. You agree to first attempt to resolve any dispute informally by contacting us at support@dinepocket.com before initiating any legal proceedings.

16Force majeure

DinePocket shall not be held liable for any failure or delay in performance of the Service resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, cyberattacks, power failures, or third-party service disruptions.
